What Information Do We Collect?
Krewe collects information about you from a variety of sources, including information that you provide directly to us when you contact us, sign-up for a customer account, and purchase products from us through the Website, visit us at a store, and information that we automatically collect about you when you access and use the Website.

By placing a small file known as a "cookie" on your device, Krewe’s and its third party providers’ servers passively gather information about all visitors' use of the System for the following purposes: statistics collection and analysis, System optimization, analytics, market research, and maintenance of user login information.
The information that we and our third party providers track with cookies includes, but is not limited to, the type of browser (such as Google Chrome or Internet Explorer) and Internet-connected devices being used to access the System, your Internet protocol (“IP”) address, your home domain or Internet service provider, your referrer URL (which is the URL for the website that you were viewing prior to visiting the System), how you were directed to the System, which specific pages you access on the System, how long you view each page, the time and date you access our System and the total number of visitors to the System and any portions thereof. This data helps us and our third party providers improve our respective product and services.

Google Analytics and Web Beacons
The System may use Google Analytics, a web analysis service provided by Google, in order to better understand your use of our System and how we can improve it. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your personal information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google.
Some of the areas of the System may contain electronic images known as web beacons (sometimes known as clear gifs) that allow Krewe, and its third party providers or affiliates, to count and track users who have visited certain portions of the System.

How Do We Use The Information That We Collect?
Krewe and our third party service providers collect and use the personal information to operate the System and deliver the Services, including to provide certain services and improve the user experience, address System integrity or security issues, and conduct research and analysis to maintain, protect, develop, and improve the System.
We may also use your personal information to send you promotional materials, whether through email or through the System, regarding Krewe, products that we think might interest you, or any third party entity or individual affiliated with individual members of Krewe.
With Whom Do We Share Information That We Collect?
For any purchases that you make through our online store, we will share some of your personal information with third party payment processors in order to process your requested transaction.
We engage service providers who may collect or receive your personal information on our behalf. Such service providers perform functions such as operating and supporting the Service, analyzing data, or performing marketing or consulting services.

Sweepstakes, Promotions, Contests & Surveys
We may offer certain online polls, surveys, contests, sweepstakes and other promotions that may be offered from time to time by us, a partner, or other entity through which you are using the System. Participation in these polls, surveys, contests, sweepstakes and promotions is completely voluntary; you have a choice about whether or not to disclose information required to enter. Information requested may include personal information such as your name, address, date of birth, phone number, mobile phone number, e-mail address, username, and/or similar information. Subject to applicable legal restrictions, we also may use the information to communicate with you, or the other people you select, about our services or products.

How Can I Opt-Out of Promotional Correspondence?
We may send you emails with promotional offers. If you would no longer like to receive information, newsletters or other promotional messages from us, please click the link at the bottom of any such email you receive from us and follow the instructions, or alternatively you may contact us at firstname.lastname@example.org with the word “UNSUBSCRIBE” or “REMOVE” in the subject line. Your email address will be removed from our marketing list. Please allow us a reasonable period of time in order to satisfy your request, as some promotions may already be in process.
How Do We Protect Information Collected About You?
Krewe takes commercially reasonable measures to secure and protect information transmitted via or stored on the System. Nevertheless, no security system is impenetrable. We cannot guarantee that information that users of the System may happen to transmit or otherwise supply will be totally secure.
The System is intended for a general audience and is not intended for use or view by children under 13 years of age, and we do not knowingly collect information about children or sell products to children. Consistent with the Children's Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13.
California Residents’ Privacy Rights
California residents have the right to request the deletion of personal information, but we may not delete some or all requested personal information as required or allowed by applicable law. California residents may also request to receive details about how we collect, use, and share your personal information. You may also request to receive the specific pieces of personal information that we have collected about you.

You agree to receive recurring automated promotional and personalized marketing text (e.g., SMS and MMS) messages (e.g. cart reminders) from KREWE, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided when signing up or any other number that you designate. Consent to receive automated marketing text messages is not a condition of any purchase. Msg & Data rates may apply. If you sign up for our text messaging program, cookies may be used to personalize your experience (e.g. send you personalized text messages such as shopping cart reminders).

- General. In the interest of resolving disputes between you and KREWE in the most expedient and cost effective manner, you and KREWE agree that any dispute arising out of or in any way related to these messaging terms and conditions ("Messaging Terms") or your receipt of text messages from KREWE or its service providers will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and can be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or in any way related to these Messaging Terms, or your receipt of text messages from KREWE or its service providers whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of when a claim arises. YOU UNDERSTAND AND AGREE THAT, BY AGREEING TO THESE MESSAGING TERMS, YOU AND KREWE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION AND THAT THESE MESSAGING TERMS SHALL BE SUBJECT TO AND GOVERNED BY THE FEDERAL ARBITRATION ACT.
- Exceptions. Notwithstanding subsection (a) above, nothing in these Messaging Terms will be deemed to waive, preclude, or otherwise limit the right of you or KREWE to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in aid of arbitration from a court of competent jurisdiction; or (iv) file suit in a court of law to address an intellectual property infringement claim.
- Arbitrator. Any arbitration between you and KREWE will be governed by the Federal Arbitration Act and the Commercial Dispute Resolution Procedures and Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the American Arbitration Association ("AAA"), as modified by these Messaging Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting KREWE. The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.
- Notice; Process. If you or KREWE intends to seek arbitration, then the party seeking arbitration must first send a written notice of the dispute to the other party by U.S. Mail ("Notice"). KREWE address for Notice is: 1020 Thalia St, New Orleans, Louisiana 70130, Attn: Chief Executive Officer. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought ("Demand"). You and KREWE will make good faith efforts to resolve the claim directly, but if you and KREWE do not reach an agreement to do so within 30 days after the Notice is received, you or KREWE may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or KREWE must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. (e) Fees. If you commence arbitration in accordance with these Messaging Terms, KREWE will reimburse you for your payment of the filing fee, unless your claim is for more than $15,000 or as set forth below, in which case the payment of any fees will be decided by the AAA Rules. If the claim is for $15,000 or less, you may choose whether the arbitration will be conducted: (i) solely on the basis of documents submitted to the arbitrator; (ii) through a non-appearance based telephone hearing; or (iii) by an in-person hearing as established by the AAA Rules. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburse KREWE for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. You and KREWE agree that such written decision, and information exchanged during arbitration, will be kept confidential except to the extent necessary to enforce or permit limited judicial review of the award. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from you or KREWE made within 14 days of the arbitrator's ruling on the merits.
- No Class Actions. YOU AND KREWE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and KREWE agree otherwise in a signed writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.
- Modifications to this Arbitration Provision. Notwithstanding anything to the contrary in these Messaging Terms, if KREWE makes any future change to this arbitration provision, other than a change to KREWE address for Notice, you may reject the change by sending us written notice within 30 days of the change to KREWE address for Notice, in which case this arbitration provision, as in effect immediately prior to the changes you rejected, will continue to govern any disputes between you and KREWE.
- Enforceability. If an arbitrator decides that applicable law precludes enforcement of any of the limitations of subsection (f) above (addressing class, representative and consolidated proceedings) as to a particular claim for relief, then that claim (and only that claim) must be severed from the arbitration and brought in court. If any other provision of these Messaging Terms is found to be unenforceable, the applicable provision shall be deemed stricken and the remainder of these Messaging Terms shall remain in full force and effect.
KREWE Monthly Sweepstakes Terms and Conditions
The KREWE Monthly Sweepstakes (the “Sweepstakes”) is a sweepstakes that begins and ends on the dates set forth herein, and is governed by the terms and conditions set forth herein. No purchase is necessary to enter or win the Sweepstakes. A purchase does not improve your chances of winning the Sweepstakes. The Sweepstakes begins at 12:00 AM EST on April 6, 2021 and ends on August 31, 2021 (the “Sweepstakes Period”).

Each new registration completed and received by KREWE during any month during the Sweepstakes Period will be entered in the prize drawing for that month. Entries for any month of the Sweepstakes Period must be received from 12:00 AM EST on the 1st of each month and on or before 11:59 PM EST on the last day of such month; provided that the initial month shall be short and shall run from 12:00 AM EST on April 6, 2021 and run through April 30, 2021, with the first drawing on May 1, 2021. ELIGIBILITY: The Sweepstakes is open solely to legal residents of the forty-eight (48) contiguous states of the United States (excluding Rhode Island) and the District of Columbia, who are at least eighteen (18) years of age and over the age of majority in their jurisdiction of residence on the date of the entry (19 or older if a resident of AL or NE, and 21 or older in MS). Employees, officers, contractors and directors of Krewe, its parents, subsidiaries, affiliated companies, and promotional agency partners and their respective immediate family (spouse, children, parents and siblings) or household members (whether or not related) are ineligible to participate in this Sweepstakes.
PRIZES: On the 1st day of each month during the Sweepstakes Period beginning on May 1, 2021, Krewe will randomly select a winner based upon the prior month’s entries (or entries during the portion of the month for the month of April 2021) using the email addresses and telephone numbers of the entrants who entered the Sweepstakes during the preceding month. Each winner will receive either one (1) Krewe optical frame (corrective lenses are specifically excluded herein) or (1) Krewe sunglass frame of the Winner’s choice, which selection will be coordinated by the Sponsor’s customer service team. An estimated value of the price for each winner is $300, but may be lower or higher depending upon frame choice by the winner. Prize is not redeemable by the winner for cash. All prizes are valid until September 1, 2022. Krewe is under no obligation to honor the Prizes after this date. If the Prizes are not used on or before the expiration date, the winners will forfeit the Prize.
SELECTION OF WINNERS: One (1) winner will be selected each month during the Sweepstakes Period as set forth above, from among all eligible entries received by Krewe during each month of the Sweepstakes Period. Drawings will be conducted by Krewe and its decisions are final on all matters relating to the Sweepstakes. Winners will be notified by emails from Krewe to the email address provided by the entrant. Each winner will be announced and contacted within one week of the drawing during any month. If any winner does not respond within 10 days or if prize notification is returned as undeliverable, then the Prize will be forfeited and an alternate winner will be selected from the remaining eligible entries for that month.
GENERAL RULES: All federal, state, local and municipal taxes are the sole responsibility of the winner. Krewe will issue a Form 1099 for the value of the prize to each Winner, and all taxes associated therewith are the sole responsibility of such Winner. Acceptance of prize constitutes permission to Krewe and its affiliates to use winner’s name, biographical information, pictures/portraits, likeness and/or voice, for purposes of advertising and trade without further compensation, unless prohibited by law. Each Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Sweepstakes or use or redemption of Prize. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules contained herein, including any decisions of Krewe. Prize is nontransferable and no substitution is allowed except at the sole discretion of Krewe, which reserves the right to award a prize of equal or greater value if an advertised prize is unavailable. Winners release Krewe and its subsidiaries, affiliates, directors, officers, employees, agents and all others associated with the development and execution of this Sweepstakes from any and all liability for damages, losses or injury resulting from participation in the Sweepstakes or acceptance or use of the Prize. The "authorized account holder" is deemed the natural person who is assigned to an email address, cellular telephone number, service provider or other organization that is responsible for assigning mobile phone numbers. If for any reason the Sweepstakes is not capable of running as planned, including due to bugs, tampering, unauthorized telephone intervention, fraud, technical failure, human error or any other causes beyond the control of Krewe that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the giveaway, Krewe reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process; to cancel, terminate, modify or suspend the Sweepstakes and select the Winners in a random drawing from among all eligible entries received prior to cancellation; or to award no prize at all. Krewe assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entry. Krewe is not responsible for: (a) incorrect or inaccurate transcription of entry information or late, lost, altered, delayed, received through impermissible or illegitimate channels, all of which will be disqualified; (b) technical failures of any kind, including but not limited to the malfunctioning of any telephone, computer online systems, computer equipment, website, server provider, network, hardware or software; (c) the unavailability or inaccessibility of any website or service; (d) unauthorized intervention in any part of the entry process or this Sweepstakes; or (e) printing, typographical, electronic or human errors which may occur in the offer or administration of this Sweepstakes or the processing of entries.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, KREWE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
The Sweepstakes shall be governed by and interpreted in accordance with the laws of the State of Louisiana, United States of America applicable to promotions fully carried out within Louisiana, without giving effect to conflict of law principles. By entering, entrants consent to the jurisdiction of the appropriate federal, state and local courts located in the State of Louisiana for any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the Prize awarded. Except where prohibited by law, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' and/or experts’ fees; and each Winner hereby waives all rights to claim punitive, incidental and consequential damages and any other damages (including attorney’s fees), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrant acknowledges that no other party nor any agent or attorney of any other party has made any promise, representation or warranty whatsoever, express or implied, not contained herein concerning the subject matter hereof, to induce the entrant to execute any document and entrant acknowledges that entrant has not executed any document in reliance on any such promise, representation or warranty not contained herein. Any waiver by Krewe and its affiliates of any term of any document in a particular instance shall not be a waiver of such term for the future. In the event that any provision of these Official Rules is found invalid or unenforceable for any reason, the remainder of the Official Rules shall remain valid and enforceable according to their terms. By entering, each entrant agrees that if any provisions are deemed not enforceable, such provisions shall be deemed modified to the minimum extent required by applicable law. Odds of winning will be determined by the total number of eligible entities received.
Winners’ List. To obtain the winners’ names, send a stamped self-addressed envelope bearing sufficient return postage accompanied by a hand-printed request entitled “Winners’ Names” to: KREWE du Optic, LLC, 1020 Thalia Street, New Orleans, LA 70130. Requests must be received on or before December 31, 2021.
